Iryna Smitiukh, attorney at law of Leshchenko & Partners, in cooperation with colleagues from Dexter Law Firm, successfully defended the client’s interests in case No. 910/8009/24 regarding the return of property and debt recovery under a lease agreement.

The essence of the case:

After the expiry of the lease agreement, the lessee failed to return the vehicles, continued to use the equipment without legal grounds and did not pay the money. The lessor went to court to protect its rights and obtain compensation.

Result:

Thanks to the clear and reasoned position of attorney Iryna Smityukh, the Court of Appeal upheld the decision of the Kyiv Commercial Court, which

  • obligated the tenant to return the property,
  • collected the arrears of rent, penalties, inflationary costs and 3% per annum,
  • additionally collected UAH 4,400,000 of fine – as double rent for the period of delay in accordance with Art. 2 of Art. 785 of the Civil Code of Ukraine.

According to Art. 785 of the Civil Code of Ukraine, upon termination of the contract, the lessee is obliged to return the property immediately. In the event of a delay, the landlord is entitled to a penalty of double the rent for the entire period of delay. This provision is an effective tool for legal protection of the owner.
