LESHCHENKO & PARTNERS secured the cancellation of tax claims worth over UAH 800 million
The law firm LESHCHENKO & PARTNERS has successfully defended the interests of the private enterprise “Libra-Trade” in a tax dispute against the Main Department of the State Tax Service in Kyiv.
The dispute concerned the appeal of tax notices-decisions totaling over UAH 800 million, which were issued as a result of an audit initiated with significant procedural violations.
The lawyers proved that:
- the audit was initiated on the basis of an unlawfully updated audit schedule;
- the audit order was served in violation of the requirements of the Tax Code of Ukraine;
- the tax authority lacked the authority to amend the audit schedule within the current year.
On April 29, 2025, the court of first instance, after the case had been remanded by the Supreme Court for a new review, ruled in favor of the plaintiff. The court declared the actions of the tax authority unlawful and annulled the tax notices-decisions for a total amount exceeding UAH 800 million.
