By June 5, men liable for military service aged 25 to 60 who were previously recognized as “limitedly fit” must undergo a military medical commission (MMC) again. Failure to appear is subject to administrative liability, but not always through the fault of the citizen.

In a commentary for the UNN news agency, counsel and attorney at law at LESHCHENKO & PARTNERS Serhii Zayanchukovsky shared his observations on the Military Medical Commission and legal reservations:

“The law declares that citizens can choose whether to apply to the TCC or use the Reserve+ electronic cabinet. In practice, everything turns into a lottery. In some regions, MCC doctors are really waiting for people with an electronic referral, while in others, this possibility simply does not exist.”

The lawyer emphasizes that some persons liable for military service, having a valid electronic referral, are forced to stand in line at the MCC for several days in a row to receive a paper document. At the same time, it is the employees of the centers who can refer to “system malfunctions” or a limited number of referrals.

The lawyer emphasizes that the imposition of a fine in the amount of UAH 17,000 to UAH 25,500 should not be automatic, especially if the violation was the result of the TP’s own actions or inaction.

“The fine for failure to appear can and should be appealed, especially if there is evidence that the person tried to undergo the inspection but faced obstacles from the authorities. Comments by TCC employees such as “you should have come earlier” have no legal meaning. If the state requires it, it must provide a mechanism for implementing this obligation ”
