The first verdict in a raiding case: LESHCHENKO & PARTNERS defended the client’s rights
Attorney at Law Oleksandr Smitiukh at LESHCHENKO & PARTNERS, successfully represents the interests of the victims — the owners of one of the leading agricultural enterprises in Vinnytsia region, whose assets became the target of an organized raider attack.
In 2020, the company, which is among the largest fruit producers in Ukraine, faced an attempt to illegally re-register over 80% of its corporate rights, amounting to more than 200 million UAH. This was only one episode in a pattern of systemic pressure on companies associated with our clients.
As a result of the coordinated efforts of the Leshchenko & Partners team, in cooperation with detectives of the Bureau of Economic Security and prosecutors of the Prosecutor General’s Office, the following was achieved:
- The illegal alienation of corporate rights to a significant share of assets was halted;
- The perpetrator was found guilty and sentenced to 5 years of imprisonment under Part 3 of Article 206-2 of the Criminal Code of Ukraine and 3 years under Part 1 of Article 205-1 of the Criminal Code of Ukraine (with a probationary period);
- Based on a plea agreement, the convicted individual committed to cooperating with the investigation. The identities of the crime’s organizers and instigators have already been established.
This decision is a significant outcome not only in this particular case but also an important step in combating organized corporate raiding in Ukraine.
