The team of LESHCHENKO & PARTNERS has achieved a final victory in a case concerning the protection of the rights and professional reputation of a private notary.
In April 2025, the Sixth Administrative Court of Appeal upheld the arguments of our attorneys, declaring unlawful the decisions of the Ministry of Justice of Ukraine, the Higher Qualification Commission of Notaries, and the Central Interregional Department of the Ministry of Justice in Kyiv to annul the notary’s certificate and terminate notarial activity.
Subsequently, the Ministry of Justice and its regional department repeatedly attempted to appeal this decision to the Supreme Court. However, by rulings dated September 29 and October 7, 2025, the Supreme Court refused to open cassation proceedings, finding the appellants’ arguments unsubstantiated.
Thus, all attempts by the state authorities to challenge the decision have been exhausted, and the case has reached its final conclusion.
Case summary:
The lawsuit concerned the appeal of the Ministry of Justice’s orders and decisions to annul the notary’s certificate based on alleged repeated violations of professional ethics related to the notary’s actions as a state registrar in updating information about the ultimate beneficial owners of legal entities. The defendants claimed these actions could have violated sanctions legislation.
The lawyers of LESHCHENKO & PARTNERS conducted a comprehensive analysis of the relevant legislation and disciplinary procedures of the Ministry of Justice, proving the absence of legal grounds for the annulment and highlighting numerous procedural violations by state authorities.
