Attorney and Intellectual Property Counsel at LESHCHENKO & PARTNERS, Serhii Zaianchukovskyi, took part as a speaker at the VIII All-Ukrainian School of Contract Law.

In December, Kyiv hosted the VIII All-Ukrainian School of Contract Law, organized by the Kharkiv branch of the League of Students of the Ukrainian Bar Association. For the seventh consecutive year, the event has brought together law students from across Ukraine to focus on the practical aspects of contract law and current court practice.

Among the speakers was Serhii Zaianchukovskyi, who has been advising businesses for more than 17 years on complex legal matters, developing legal strategies, and protecting intellectual property rights at both national and international levels.

As part of the School, Serhii delivered a lecture entitled “The Psychology of Contracts Through the Lens of Case Law: How Behavioral Factors Transform into Legal Risks.” His presentation focused on how human behavior, expectations, and emotional decision-making by the parties to a contract influence the emergence of disputes and litigation, as well as on practical tools for mitigating such risks already at the contract drafting stage.

Special attention was given to court practice on the application of the contra proferentem principle (Lat. verba chartarum fortius accipiuntur contra proferentem — contractual terms should be interpreted against the party that drafted them). The speaker analyzed how this approach is applied by courts in disputes involving ambiguous contractual provisions and why the quality of wording and the balance of the parties’ interests become critically important for the party initiating the contract text.
