IV WHITE-COLLAR CRIME FORUM: discussing current trends in WCC practice in Ukraine

The team of LESHCHENKO & PARTNERS took part in the IV WHITE-COLLAR CRIME FORUM — one of the key professional events in the field of White-Collar Crime and criminal justice, organized by the “Yurydychna Praktyka” publishing house.
The forum brought together attorneys, judges, law enforcement representatives, and legal experts to discuss current trends in pre-trial investigations, court practice, and practical aspects of defence in criminal proceedings.
As part of the forum, Rodion Dostatnii, Attorney-at-Law and Counsel of the WCC and Criminal Defence Practice at LESHCHENKO & PARTNERS, delivered a presentation titled: “Excessive Bail: New Risks for Bail Providers”.
The presentation focused on practical trends currently shaping criminal proceedings in Ukraine, including the determination of bail without considering actual access to assets, risks faced by bail providers after posting bail, as well as the balance between procedural coercion and the real right to defence.
Particular attention was paid to the compliance of such approaches with the standards of the European Court of Human Rights and to how procedural mechanisms originally intended as safeguards may, in practice, transform into additional instruments of pressure.
